If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including:

  • Right to Know: Request disclosure of the personal information we collect, use, disclose, and sell;

22. Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

22.1 Agreement to Arbitrate

You and LifeMatch agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with LifeMatch (collectively, "Disputes") will be resolved exclusively through binding individual arbitration rather than in court, except as otherwise provided herein.

22.2 Arbitration Rules

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by a single arbitrator. The arbitration will take place in the county where you reside or, at your election, by telephone or video conference.

22.3 Arbitration Fees

Payment of arbitration fees will be governed by the AAA's rules. If your claim does not exceed $10,000, LifeMatch will pay all arbitration fees. If your claim exceeds $10,000, fees will be allocated as determined by the arbitrator.

22.4 Arbitrator's Authority

The arbitrator shall have exclusive authority to resolve all Disputes, including the arbitrability of any dispute and the enforceability of any provision of this arbitration agreement. The arbitrator's decision shall be final and binding.

23. Class Action Waiver

YOU AND LIFEMATCH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Unless both you and LifeMatch agree otherwise in writing:

  • No arbitration or court proceeding may be combined with another;
  • There is no right or authority for any Dispute to be arbitrated on a class-action basis;
  • There is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or other persons;
  • The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

If this class action waiver is found to be unenforceable, then the entirety of the arbitration agreement shall be null and void, and all Disputes shall be decided by a court.
